How to tell if I'm in Overlay

I've been using VMR9 for quite some time (forced due to overlay problem with video card ) and just tried switching back to overlay (new video card ) to avoid tearing issues. I'm still back using .15 software.

My question is should I still be seeing the see-thru menus in overlay? I have set the detailed setup to choose overlay mode, and have set everything else to default (and 3D to disabled -- what does this do anyway..), but I still can pull up the OSD and see the video moving underneath. I thought that only worked in VMR9. I checked and I don't think I have any leftover registry settings that are forcing VMR9. Am I in overlay, and if not any ideas how to get there?

PS I looked for 10 minutes to find tearing while switching back and forth, but didn't see anything overt enough to know for sure. I think I saw some in both modes, leading me to question if I'm really in overlay. Hard to tell, since I just switched video cards to a ATI9600SE, and I'm not sure what tearing will look like with this card.

Yes, you can have transparent menus using overlay, but the transparency seems to be all or nothing. With VMR9, you can have partial transparency.
