In the US, it wouldn't matter if the iTunes site was hacked or if the actual card was stolen. If you did not authorize those specific purchases, then you are not liable for the payments. You have to fill out fraud paperwork, and sometimes even have to file a police report, but generally you will get your money back. Obviously things are probably different for accounts opened in another countries.

I'm not a lawyer (or a banker) but it seems to me the same reasoning can be applied to the iTunes hack. The hacker never had your credit card info, or used it fraudulently; they just went joyriding on your iTunes account, which you had already authorized to use your credit card for all charges arising from that account.
Good analogy, but a crime was committed when the transponder was stolen and once out of my control is no longer authorized by me.

The consumer protection laws talk about unauthorized use and whether it's "direct" (had the card/number) unauthorized use or "indirect" (had access to the account that had the card/number on file) unauthorized use, it's still unauthorized. Worse case I file the dispute paperwork and after investigation I have to pay for it anyway.

Just got an e-mail back from Apple, telling me I have to go through the bank for this.... Ugh. Maybe if I read the e-mail to the bank customer service department, they will actually do something.

How was the CC attached to iTunes (Direct Debit - ATM or Cedit Card MasterCard - Visa - AMEX)??? Here are some (hopefully) helpful links.

It sure would be nice if that was the way it worked. I refuse to bank with wells fargo for the reason that they said that fruadulent charges on my debit card were indeed fraud, but the credit card devision of wells fargo says that they don't think it was fraud so all the debits that went to the credit card because of overdrafts are somehow my fault. Not cool.
