Bare-metal installation is possible with the family pack disks, and is my preferred approach when I have a workstation with an old (licensed) version of Windows that needs to be upgraded. I would much rather start fresh, than deal with any residual effects of prior versions of Windows.

From a licensing perspective, it is up to each buyer to make sure that they are not violating any terms of the license agreement. Wouldn't want the Microsoft police breaking down your door now, would you?
